Small loans in India: rules and safeguards

How small loans work in India: RBI-regulated lenders, digital lending rules and the Key Fact Statement, microfinance, CIBIL reports and illegal loan apps.

Indian rupee notes next to a smartphone and a notebook

In India, small loans come from a wide range of sources: banks, non-banking financial companies (NBFCs), microfinance institutions, gold loan lenders, cooperative banks, self-help groups and, increasingly, digital lending apps. The Reserve Bank of India (RBI) has tightened the rules several times in recent years, particularly for digital lending, after widespread complaints about hidden charges, data misuse and abusive recovery by unregulated apps.

This guide explains who may lend, what the RBI requires, how credit bureaus work and how to recognise illegal loan apps. Mini-Pret.com does not provide loans or connect borrowers with lenders.

Who is allowed to lend

The RBI regulates commercial banks, small finance banks, NBFCs (including NBFC-microfinance institutions) and, with state authorities, cooperative banks. Lending to the public as a business generally requires being one of these regulated entities, or operating under a state money-lending law that licenses local moneylenders.

  • Banks and small finance banks: personal loans, credit cards, overdrafts and loans against deposits.
  • NBFCs: personal loans, consumer durable loans and many digital products. You can check whether an NBFC is registered on the RBI website.
  • Microfinance lenders: small collateral-free loans to low-income households, often through group lending.
  • Gold loans: loans secured by jewellery, widely used for quick needs, with rules on the maximum loan-to-value ratio.
  • Self-help groups and cooperatives: community-based savings and credit, often linked to banks.

RBI rules for digital lending

The RBI's digital lending guidelines, introduced in 2022 and later consolidated, set clear requirements for loans offered through apps and websites:

  • the loan must be made by an RBI-regulated entity, and the app must disclose which lender is behind it;
  • money must be disbursed directly to the borrower's bank account and repaid directly to the lender, not through a third party's account;
  • borrowers must receive a Key Fact Statement showing the all-in cost as an annual percentage rate (APR), including fees;
  • fees not mentioned in the Key Fact Statement cannot be charged;
  • a cooling-off period lets you exit the loan by repaying the principal and proportionate APR without penalty;
  • apps may collect only the data they need, with your explicit consent, and should not access contacts or media files;
  • each lender must have a grievance redressal officer.

Our page on loan apps explains app permissions and data protection in more detail.

Microfinance rules

Under the RBI's 2022 microfinance framework, a microfinance loan is a collateral-free loan to a household with annual income up to a set limit, and lenders must cap total loan repayments at a share of household income. Lenders must also publish their pricing and cannot impose prepayment penalties on these loans. The aim is to prevent over-indebtedness from multiple overlapping group loans.

Credit bureaus and your report

Four credit information companies operate in India: TransUnion CIBIL, Experian, Equifax and CRIF High Mark. You are entitled to one free full credit report a year from each. Check them before applying, and dispute any error with the bureau and the lender. Missed payments on even small app loans are reported and can affect later bank applications. If your score is weak, our general guide to a loan with poor credit offers broader advice.

Compare the true cost

Interest is often quoted monthly, or as a flat rate on the original amount, both of which make a loan look cheaper than it is. Always compare the APR in the Key Fact Statement and the total amount repayable, including processing fees and GST on fees. Ask whether there are charges for late payment, cheque or mandate bounces and foreclosure.

A simple example shows why this matters. A loan advertised at a flat 1.5% a month on the original amount, repaid in equal instalments over a year, carries an effective annual rate well above 18%, because you keep paying interest on money you have already repaid. Processing fees deducted at disbursement push the real cost higher still, since you receive less than the amount on which interest is charged. The Key Fact Statement exists precisely to make these effects visible, so read it before you accept, and keep a copy.

Checklist before you borrow

  • Is the lender a bank or an RBI-registered NBFC, and is it named in the app?
  • Have you received a Key Fact Statement with the APR?
  • Will the money arrive directly in your own bank account?
  • Does the app ask for contacts, photos or location it does not need?
  • Do you know the cooling-off period and foreclosure terms?
  • Can you meet the EMI from regular income after essential expenses?

Illegal loan apps and scams

  • Apps not linked to any regulated lender, or that change names frequently.
  • Requests for an upfront "processing" or "insurance" fee before disbursement.
  • Very short tenures, such as one week, with large deductions from the amount paid out.
  • Harassment, threats or messages to your contacts. Recovery agents of regulated lenders must follow RBI conduct rules.
  • Offers spread through social media, messaging groups or SMS links.

Complaints against regulated entities can go to the lender's grievance officer and then to the RBI Ombudsman under the Integrated Ombudsman Scheme. Unregulated lending and fraud can be reported to the police cyber crime portal and through the RBI's Sachet portal.

Alternatives to a high-cost loan

  • Government schemes: small business borrowers can look at Mudra loans offered through banks and other lenders under the Pradhan Mantri Mudra Yojana.
  • Self-help groups: savings-linked group credit can be cheaper and more flexible.
  • Loan against a fixed deposit or insurance policy: usually priced close to the deposit rate.
  • Employer salary advance or family support with written terms.
  • Debt advice: if you are juggling several loans, speak to your bank about restructuring before taking a new one. See our page on combining small debts.
